Claudia Trevisan, in SMDP’s June 25-26 issue, urged passage of the 2021 Judiciary Act, which would add four seats to the Supreme Court.
I urge Ms. Trevisan to rethink the idea that such a law can automatically restore ‘balance to the court’, as she and many others assume in the wake of yesterday’s 6-3 decision overturning Roe vs. Wade.
There is no guarantee whatsoever that this balance will emerge in the event that another such case comes before the justices. A 7-4 anti-choice split is just as likely, or some other lopsided result.
The judiciary was never the arena in which to secure a woman’s right to choose. Even before the current Court shot Roe down once and for all, its 50-year history was full of cliffhangers.
As President Biden said recently, we must codify that right into law. Nothing else will bring it about.
